Cigar Rights of America Cigar Trip Raffle Official Rules and Legal Disclosures

ELIGIBILITY:

VOID WHERE PROHIBITED OR RESTRICTED BY LAW.

The Drawing is open to Cigar Rights of America members within the United States only. Employees, officers, directors, representatives, and immediate family members of Cigar Rights of America and their respective parent companies, affiliates and subsidiaries are not eligible to participate in this Drawing.

Drawing promoters and/or Cigar Rights of America are not responsible for lost or stolen entries. Drawing entries will be disqualified, in the sole discretion of Cigar Rights of America, if attempts are made to disrupt the Drawing or circumvent the terms and conditions of these Official Rules. If the above occurs, Cigar Rights of America reserves the right to remedy any such action, disruption, or circumvention in a manner, determined solely by Cigar Rights of America that is fair and equitable to Drawing participants.

All Winners of the Drawing are responsible for obtaining their own transportation and/or airfare to the destination, and all related costs. The Drawing Prizes are not transferable or assignable and they are not redeemable for cash. All winners are responsible for the payment of any and all taxes and/or licenses and/or other related local, State, Federal fees that may apply to such winnings. Taxes on prizes are solely the responsibility of the winners. Cigar Rights of America reserves the right to replace the advertised prize(s) with a prize of equal or greater value if the advertised prize(s) is/are no longer available. Cigar Rights of America will not be responsible for replacing any lost or stolen elements of any prize package. All prizes will be awarded. Odds of winning depend on the number of eligible entries received, according to the eligibility requirements in this Drawing.

Winners will be selected by random drawing once each month from and among all eligible entries received. Random drawings will be held under the supervision of Cigar Rights of America. All decisions by Cigar Rights of America are final and binding. Winners will be notified by e-mail, telephone or mail, which notification will be determined in the sole discretion of Cigar Rights of America. Each winner may be required to provide Cigar Rights of America with proof that he or she is the authorized holder of the membership associated with the winning entry. If a selected winner cannot be contacted, is ineligible, fails to claim a prize, or fails to return a completed and executed affidavit and release as required, an alternate winner may be selected. Except where prohibited by law, acceptance of any prize constitutes permission for Cigar Rights of America to use the winner's names, photographs, likenesses, voices, addresses (only city and state), and testimonials, in print, broadcast, or new media, in perpetuity, in any manner they deem appropriate in connection with promoting this or any other drawing and/or promotion sponsored by them without further compensation.

CONDITIONS:

By entering, participants agree to be bound by these complete Official Rules and the decisions of Cigar Rights of America, which shall be final. All international, federal, state, and local laws apply. Cigar Rights of America and its employees, officers, directors, shareholders, agents, and representatives and their parent companies, affiliates, subsidiaries, and advertising, promotion and legal advisors are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible entries; (ii) failed, returned, or misdirected notifications based on inaccurate information provided by the winner; or (iii) telephone, electronic, hardware, or software program, network, Internet, or computer malfunctions, failures, or difficulties resulting from participation in this Drawing of otherwise; (iv) errors in transmission; (v) any condition caused by events beyond the control of Cigar Rights of America that may cause the Drawing to be disrupted or corrupted; (vi) any injuries, losses, or damages of any kind caused by a prize or resulting from acceptance, possession, or use of a prize, or from participation in the Drawing; or (vi) any printing or typographical errors in any materials associated with the Drawing.

The Drawing shall be construed and governed by, and any and all actions or claims in any way related to this Drawing are subject to, the federal laws and regulations of the United States , the state laws and regulations of the Commonwealth of Virginia , and the laws of the international destination. Any and all actions or claims in any way related to this Drawing shall be filed in the courts of the Commonwealth of Virginia , County of Fairfax . By Providing an Entry to this Drawing, you submit to the jurisdiction of the courts of the Commonwealth of Virginia in the United States for any and all actions or claims in any way related to this Drawing, and expressly agree that such actions or claims are subject to the federal laws and regulations of the United States, the state laws and regulations of the Commonwealth of Virginia, and the laws of the international destination. Cigar Rights of America may prohibit you from participating in the Drawing, if at the sole discretion of Cigar Rights of America, you repeatedly show a disregard for the Drawing Official Rules, or act (1) in an unsportsmanlike manner; (2) with an intent to annoy, abuse, threaten, or harass any other player or a representative of Cigar Rights of America; or (3) in any other disruptive manner.

RELEASES:

By participating, entrants agree that Cigar Rights of America, those involved in the development, production, implementation and distribution of this promotion and their respective parent companies, affiliates, subsidiaries, service providers, and agencies, and their directors, officers, agents, employees, attorneys, and any other person or entity associated with such entities and/or promotion shall not be liable for any and all claims, damages, losses or injuries, including any third party claims, arising from or relating to, in whole or in part, this Drawing, including entry and participation in this Drawing and acceptance, possession, use or misuse of the prizes, or any loss occurring during a Drawing winner's vacation, including loss due to theft or negligence. All entrants further agree that in the event of any third party claims, damages, losses or injuries, arising from or relating to a participant's entry or participation in this Drawing, they will indemnify Cigar Rights of America from any and all such claims, including the attorneys' fees related thereto. Cigar Rights of America shall not be liable for entries and winner notification responses that are delayed, lost, misdirected, mis-delivered, marked postage-due, illegible, mutilated, incorrect or incomplete, and such entries will be not be eligible for this Drawing. Any person attempting to defraud or in any way tamper with this Drawing will be ineligible for prizes and may be prosecuted to the full extent of the law. Cigar Rights of America reserves the right, in their sole discretion, to cancel or suspend this Drawing should any causes beyond their control corrupt the administration, security or proper play of the Drawing. Cigar Rights of America further reserves the right to modify the rules of the Drawing in any way or at any time, as long as reasonable notice is given. For an Official Winners List or a copy of these Official Rules, send a self-addressed, stamped envelope to Cigar Rights of America. Replies will be sent after the completion of the Drawing. Winners List requests must be received within six (6) months of completion of the Drawing.  

LIABILITY DISCLAIMER:

Cigar Rights of America is not responsible for any lost or stolen items while Winner is at a Destination. Cigar Rights of America is not responsible for any injuries, losses, or incidental, consequential or indirect damages caused to any Winner in connection with terrorist activities, social or labor unrest, mechanical or construction difficulties, diseases, local laws, climatic conditions, abnormal conditions or developments, travel delays, or any other actions, omissions, errors or conditions outside Cigar Rights of America's control. All Destinations are available at the sole discretion of Cigar Rights of America. Specific Destinations, promotions and dates associated with the Drawing are subject to change and may be unavailable at the time a Winner is eligible to claim a prize.
